Superkatjes terms and conditions

These terms apply to all Superkatjes cat sitting services and form, together with the agreement, the legal basis for service delivery.

Cat sitting terms and conditions

Article 1 - Definitions

In these terms and conditions, the following definitions apply:

  • Cat sitter / contractor: Superkatjes, established in the Netherlands, providing at-home cat sitting services.
  • Client / owner: the natural person booking the cat sitting service for one or more cats.
  • Cat(s): the cat or cats for which services are provided.
  • Agreement: any arrangement between client and contractor regarding cat sitting, care, key handling, medication administration, incident handling and related services.

Article 2 - Applicability

These terms and conditions apply to all quotes, requests, bookings, agreements and services of Superkatjes.

Any deviation from these terms is valid only if confirmed in writing or demonstrably confirmed digitally by the contractor in advance.

By making a booking, signing a contract or providing digital acceptance, the client declares having received, read and accepted these terms and conditions.

Article 3 - Service delivery

The contractor provides in-home cat sitting based on the information supplied by the client.

Services include only the activities agreed in advance.

The contractor performs services to the best of her knowledge and ability, but does not guarantee a specific result.

Article 4 - Client obligations

The client must provide all information relevant for safe and proper execution of the agreement fully, correctly and in time. This includes at least information about:

  • the cat's health, illness, medication and medical history;
  • behaviour, aggression, fear, territorial behaviour and bite/scratch incidents;
  • flight risk or tendency to escape;
  • feeding, allergies and daily care;
  • details of the home, alarm, locks, access and safety risks;
  • contact details of the client, emergency contact and veterinarian.

If information is incorrect, incomplete or provided too late, all resulting consequences, risks, additional work and costs are fully at the client's expense.

Article 5 - Health, hygiene and supplies

The client declares that, at the start of the care period and to the best of their knowledge, the cat(s) are free of fleas, parasites and contagious conditions, unless explicitly reported in advance and accepted by the contractor.

Throughout the full care period, the client provides sufficient food, drinking water, litter, medication, cleaning products and any other necessary care items.

If these are missing, the contractor may make necessary purchases or take measures at her reasonable discretion. All related costs are fully at the client's expense.

Article 6 - Access to the home

The client ensures correct, timely and safe access to the home.

The client is responsible for proper operation of keys, codes, intercom, locks, alarm systems and other access facilities.

If the contractor cannot enter, or if access requires extra actions, waiting time, repair work or involvement of third parties, all extra costs are borne by the client.

Article 7 - Emergency situations

An emergency situation includes, among others: illness or injury of the cat, acute health complaints, disappearance or escape, safety risks, access problems, property damage, burglary, leakage, gas/water/electricity issues, or any other situation where immediate action is reasonably necessary.

In an emergency, the contractor is authorised to independently take measures she reasonably considers necessary in the interest of the cat, the home or safety.

This also includes contacting a veterinarian, emergency service, locksmith, police, fire brigade, neighbour contact, property manager or any other necessary third party.

If the client and/or emergency contact cannot be reached immediately, the client hereby grants advance permission for the contractor to arrange necessary assistance on the client's behalf.

Article 8 - Veterinary and other costs

All costs resulting from an emergency or necessary measures, including veterinary, medication, transport, locksmith, travel, parking, administrative and other direct costs, are fully at the client's expense.

The contractor may prepay these costs or settle them on behalf of the client and is entitled to recover them in full from the client.

Article 9 - Liability

The contractor is not liable for damage, loss, costs or incidents arising from or related to:

  • incorrect, incomplete or late information provided by the client;
  • pre-existing or hidden medical conditions of the cat;
  • stress, illness, injury, behavioural change, disappearance, escape or death of the cat;
  • aggressive, fearful, unpredictable or territorial behaviour of the cat;
  • refusal of food, medication or care by the cat;
  • damage caused by the cat to the home, property or third parties;
  • defects or unsafe situations in or around the home;
  • acts of veterinarians, emergency services, locksmiths or other engaged third parties;
  • force majeure.

To the extent permitted by law, any liability of the contractor is limited to the amount paid by the client for the relevant care period.

Liability for indirect damage, consequential damage, loss of income, emotional damage, follow-up costs and third-party damage is explicitly excluded, to the extent permitted by law.

Nothing in these terms excludes liability where exclusion is not permitted under mandatory law.

Article 10 - Indemnity

The client fully indemnifies the contractor against third-party claims arising from:

  • the behaviour of the cat;
  • the condition or safety of the home;
  • incorrect or incomplete information from the client;
  • failure by the client to comply with obligations under the agreement;
  • circumstances not directly caused by intent or wilful recklessness of the contractor.

Article 11 - Medication

If the contractor administers medication at the client's request, this is done solely based on instructions provided by the client.

The contractor is not liable for consequences of incorrect instructions, incorrectly supplied medication, hidden medical conditions, or refusal of medication by the cat.

Medication is administered only if agreed in advance and reasonably feasible.

Article 12 - Incident report

The contractor is entitled to prepare an incident report for incidents, special circumstances or emergencies.

An incident report may include date, time, location, type of incident, factual description, actions taken, communication with client or third parties, costs incurred and final status.

Such report serves as business documentation of the contractor's observations and actions, unless proven otherwise.

Article 13 - Payment

Payment must be made in full in advance, unless agreed otherwise in writing.

A booking is final only after confirmation by the contractor and receipt of full payment.

If the client does not pay on time, the contractor is entitled to suspend or cancel the service.

Article 14 - Cancellation

Cancellation is free of charge up to 7 days before the start of the care period.

For cancellation within 7 days before the start of the care period, 50% of the paid amount will be refunded.

For cancellation within 24 hours before the start, or after the care period has started, no refund will be made.

Costs already incurred or unavoidable costs may be charged or settled in full.

Article 15 - Suspension, refusal and termination

The contractor is entitled to immediately suspend, refuse or terminate the service in case of:

  • aggressive or dangerous behaviour of the cat;
  • unsafe, threatening or unhygienic circumstances;
  • unreachability of the client in risky situations;
  • inaccessible home;
  • lack of necessary care supplies;
  • misleading information, withholding relevant information or non-payment.

In such cases, the client remains obliged to pay all agreed and incurred costs in full.

Article 16 - Force majeure

The contractor is not liable for shortcomings caused by force majeure, including illness, accident, family circumstances, extreme weather conditions, traffic issues, technical failures, government measures, emergencies and other circumstances outside her reasonable control.

In case of force majeure, the contractor will make reasonable efforts to inform the client as soon as possible.

Article 17 - Personal data

The contractor processes personal data only as required for execution of the agreement, communication, administration, invoicing and incident handling.

Personal data is processed in accordance with applicable privacy legislation.

Article 18 - Governing law and disputes

All agreements and legal relationships between client and contractor are exclusively governed by Dutch law.

Disputes are submitted to the competent court in the district where the contractor is established, to the extent permitted by law.
